Terms and Condition

I) DEFINITIONS

• “Alliance partner” shall mean Novarris Fashion Trading Private Limited, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• “Customer/s” for the purpose of this Offer shall mean person who holds a valid ICICI Bank VISA / MASTER Credit card issued by ICICI Bank and who has received communication from ICICI Bank with respect to the Offer.
• “Cardholder” shall mean a customer to whom the card has been issued and who is authorized to hold the card. "Card" shall mean ICICI Bank VISA / MasterCard Credit Card issued by ICICI Bank, that is valid and subsisting during the Offer Period (does not include ICICI Bank EMI Card, Corporate Card, Business Card and ICICI Bank American Express Credit Card). “Offer” shall mean cashback/benefit provided by the "Alliance partner" on purchase of Products/Services using ICICI Bank Credit Card.
• “Offer Period” shall mean the period commencing from the date of effectiveness from: August 16, 2018 till September 15, 2018, both days inclusive.
• "Website" shall mean the following "website" URL: www.jabong.com of the "Alliance partner"
• “Void Transactions" shall mean wherein the transaction has taken place but has been rejected /cancelled/ been unsuccessful at the "website" of the "Alliance partner".
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to the Card in addition to these Terms and Conditions.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II) Offer terms and conditions :

• Get up to Rs. 1000 cashback on shopping for Rs. 4999 and above
• The maximum discount on already discounted products shall not exceed 35% of the MRP of the product or max. up to Rs 1,000 whichever is lower
• Offer valid on Credit Card EMI transactions only
• EMI offer applicable on EMI tenures of 3, 6, 9 & 12 month
• Offer available on www.jabong.com and Jabong App.

Steps to avail the offer

• Log on to www.jabong.com
• Select products of choice
• Enter your coupon code at the time of booking to be eligible for the discount during checkout before making payment.
• Make your Payment through ICICI Bank Credit cardholder.

iii) Other Terms and Conditions prescribed by Alliance Partner

• This marketing program (“Program”) is from ICICI Bank under an arrangement with Jabong.com (“Merchant”) and is open to all residents of India holding a valid and current ICICI Bank Credit Card (“Cardholder”) and to whom a communication is sent either by ICICI Bank and/or Merchant.
• The Validity of the Program (“Term”) is from 16 August ‘18 00:00 to 15 September ‘18 59:00 (both days included), unless extended by ICICI Bank and the Merchant.
• Under this Program:
• A Cardholder can avail additional cashback on EMI purchases at Jabong.com and Jabong App using ICICI Bank Credit card as below, during the program term.

• Maximum cashback per card account is capped at Rs.1,000
• The cashback is over and above any EMI subvention cashback/discount given by the OEM/Brand.
• The cashback is applicable for transaction done for EMI transactions only.
• EMI tenures allowed are :- 3,6,9 and 12 months
• Bank Rate of Interest is applicable on every transaction as per the Bank policy.
• The cashback will be credited in Card account in 90 days after the campaign ends.
• In the event orders are cancelled or returned either by Jabong or by Customer, the Customer will not be eligible for the cashback.
• The Cashback amount will be calculated on the net transaction value.
• Any query regarding this Program or the cashback shall only be entertained till November 30 2018. Post such date; ICICI Bank or Jabong will not entertain any correspondence or communication regarding this Program from any cardholder.
• ICICI Bank does not endorse any of the products or brands being offered under the Program and will not accept any liability pertaining to the quality, delivery or after sales service of such products which shall be at the sole liability to Merchant.
• All the existing offers, gifts, discounts etc. that are being offered by the Merchant can be availed by the Cardholders over and above of this exclusive offer as mentioned in the communication
• Pictures of products shown in the communication sent to the customer either through mailers or advertised on our website, are representative only and may not bear a resemblance to the actual products. ICICI Bank shall under no circumstances be responsible towards the same.
• Products offered under this Program are subject to availability from the respective participating outlets of Merchant and accordingly ICICI Bank in no circumstances shall be liable for non-availability of any of the products.
• Under no circumstance will the offer/cashback being offered under this Program be settled with cash in lieu by ICICI Bank or by Merchant
• All government levies such as sales tax, TDS, local taxes, octroi etc., shall be payable by the Cardholder as applicable at the time the respective Programs were offered.
• Cardholders are not bound in any way to participate in the Program and any participation is deemed to be voluntary.
• ICICI Bank and Merchant reserve the right to modify or change any of the terms and conditions applicable to this Program at any time at its own discretion.
• By participating in the Offer, the Customer agree to be bound by the terms and conditions contained herein.

Other Terms and conditions - prescribed by ICICI Bank

• The Offer is brought to you by the Alliance Partner and the Card Holder/s shall be bound by the terms and conditions stipulated by the Alliance Partner in this regard.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services.
• The Offer is not available wherever prohibited and / or on merchandise / products / services for which such alliances cannot be offered for any reason whatsoever.
• The participation in the Offer is entirely voluntary and it is understood, that the participation by the Cardholder/s shall be deemed to have been made on a voluntary basis.
• Terms and Conditions of ICICI Bank and third parties apply. ICICI Bank makes no representation about the quality, delivery, usefulness or otherwise of the goods/services offered by the third party. Nothing contained herein shall constitute or be deemed to constitute an advice, invitation or solicitation to purchase any products/ services of ICICI Bank / third party.
• Images used in all the communications pertaining to the Offer are for representation purpose only.

• If the Cardholder/s ceases to be Cardholder/s at any time during the subsistence of the Offer, all the benefits under the Offer shall lapse and shall not be available to the Cardholder/s.
• All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai.
• All communication / notices with regard to this Program should be addressed to "ICICI Bank Ltd., ICICI Bank Phone Banking Group, P. O. Box No. 20, Banjara Hills, P. O. Hyderabad - 500034".
• In all matters relating to the Offer, the decision of ICICI Bank shall be final and binding in all respects.
• These Terms and Conditions shall be in addition to and not in substitution / derogation to the Primary Terms and Conditions governing the Credit Cards. All capitalized terms used but not defined herein shall have the respective meanings ascribed to it in the Primary Terms and Conditions.
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services offered by the merchant. Any dispute or claim regarding the goods and services must be resolved by the Cardholder/s with the merchant directly without any reference to ICICI Bank.
• ICICI Bank shall not be liable in any manner whatsoever for any loss/ damage/ claim that may arise out of use or otherwise of any goods/ services availed of by the Card holder/s under the offer.
• ICICI Bank reserves the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• ICICI Bank reserves the right to disqualify any merchant or Cardholder/s from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer.
• All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the Offer shall be borne solely by the Cardholder/s and ICICI Bank will not be liable in any manner whatsoever for any such taxes, duties, levies or other statutory dues.
