Terms and Condition

I. DEFINITIONS

• “Alliance partner” shall mean Getit Stores Private Limited as “AskmeBazaar.com”, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• “Customer/s” for the purpose of this Offer shall mean a person who is using ICICI bank Netbanking services or holds a valid ICICI Bank VISA/MASTER Debit card or holds a valid VISA/MASTER Credit Card issued by ICICI bank and who has received communication from ICICI Bank with respect to the Offer.
• “ICICI Bank Net Banking User” shall mean a person who holds an ICICI Bank savings account, loan / facility account(s), depository account(s) and/or any other type of account(s), so maintained with ICICI Bank or its Affiliate which are eligible account(s) for purposes of ICICI Bank Net Banking Service(s) and who has received communication from ICICI Bank with respect to the Offer.
• “Cardholder” shall mean a customer to whom the Facility has been granted by virtue of such customer holding a Card.
• "Card" shall mean credit card, which has been issued by ICICI Bank and is valid and subsisting during the Program Period.
• “Offer” shall mean instant discount/benefit provided by the "Alliance partner" on purchase of Products/Services using ICICI Bank Debit/Credit/Prepaid/Gift Card or Net banking services.
• "Website" shall mean the following website of the Alliance partner "www.askmebazaar.com/icicibankoffers
• "Void Transactions" shall mean wherein the transaction has taken place but has been rejected /canceled/ been unsuccessful at the ""website"" of the "Alliance partner".
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to ICICI Bank’s internet banking facility/service.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. Offer

The Alliance Partner shall offer discounts upto 80% on purchase of its products to the Customer/s during the Offer Period. The discount shall be available on all products listed on www.askmebazaar.com/icicibankoffers

Redemption Process

• Log on to http://www.askmebazaar.com/icicibankoffers.
• Customer will browse, select and buy products of his/her choice.
• Payment will be restricted to ICICI Bank instruments ( CC/DC/Net banking).

III. Customer Escalation Process

• Buyer Helpline Number : 04444 4444.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at @ help@getitbazaar.com or 04444 4444 without any reference to ICICI Bank. The same shall be addressed by AskmeBazaar only up to a period of 15 days after the date of transaction/purchase.
• All communication / notices with regard to this offer should be addressed to Getit Infoservices Pvt. Ltd. address: GYS Heights, Plot 10&11, Sector 125, Gautam Budh Nagar, Noida 201301.

IV. Terms and Conditions applicable to the Offer prescribed by Getit Stores

• The Services and the Indirect Services on the Getit Platform are only available to persons who are competent to enter into legally binding contracts under the Indian Contract Act, 1872.
• It is hereby clarified that all Products listed by the Users and the content advertised are provided by the Users registered with the Getit Platform and are third party user generated content. The User agrees and acknowledges that it has had the opportunity to independently investigate, analyze and construe the business opportunity being offered under these Terms and Conditions.
• The User does hereby specifically agree that it shall, at all times, comply with the requirements of the Information Technology Act, 2000 (“IT Act”) as also rules, regulations, guidelines, bye laws and notifications made thereunder, [while assessing or feeding any information/data into the computers, computer systems or computer network of Getit Stores]. The User does further unequivocally declare that in case of any violation of any provisions of the IT Act and/or rules, regulations, guidelines, byelaws and notifications made thereunder, the User shall be solely responsible, at its sole cost and expenses for all acts, deeds and things and that the User alone shall be liable for civil and criminal liability there under or under any other law for the time being in force.
• The Users shall keep confidential, all information it receives by transacting on the Getit Platform. Breach of this Section and terms of the Privacy Policy displayed on the Getit Platform by a User will be considered a material breach and result in immediate discontinuation of the Services by Getit Stores to such User. Breach of confidentiality provisions by a User shall cause immediate termination and appropriate legal action being initiated against such User by Getit Stores.
• The User acknowledges that it shall take all precautions as may be directed by Getit Stores to ensure that there is no breach of security and integrity of the Getit Platform. Getit Stores shall not be responsible for any loss incurred by a User for a failed / incomplete Transaction on the Getit Platform.
• The User acknowledges that Getit Stores’ liability with respect to the Services and Indirect Services shall be limited and shall be as per these Terms and Conditions. Getit Stores reserves the right, in its sole discretion and without assigning any reason, to exclude certain Products offered by a User from being displayed for sale on the Getit Platform, wherein such Products are deemed unfit or unsuitable by Getit Stores at its sole discretion.
• The User acknowledges that Getit Stores has no connection or interest whatsoever in the business of the User selling the Products on the Getit Platform or the Products marketed by such Users and Getit Stores does not in any manner take part in the business of the User, directly or indirectly and is not responsible for the Products provided by the User. A User buying the product hereby acknowledges that before placing an order for a Product the User being the seller has performed a diligence and background check of the User selling the Product and is entering into the Transaction being aware of the Terms and Conditions. The User further acknowledges that Services and Indirect Services being provided by Getit Stores is being provided by it as an independent contractor, and Getit Stores is in no manner acting as an agent of either the User or of the third party service provider Getit Stores.
• The User agrees and confirms that the payment gateway and logistic support Services are being provided by Getit Stores on a best efforts basis with all efforts to keep these valid and subsisting. Getit Stores shall not in any manner be liable to a User for failure or delay in provide these Services.
• A User will be required to provide a valid phone number in order to avail the Services provided by Getit Stores, including and not limited to placing orders for buying the Products. By registering their phone number with Getit Stores, the User consents to be contacted by Getit Stores via phone calls and/or SMS notifications, in case of any order or shipment or delivery related updates.
• By purchasing the Products using the Getit Platform and authorizing Getit Stores to process the payment, the User agrees, accepts and understands that Getit Stores as part of its Services is only a facilitator providing an electronic, automated online electronic payment, receiving payment through cash on delivery, collection and remittance facility for the sale and purchase of the Products.
• The User understands that by ordering a Product using the Getit Platform, the User buying the Product is entering into a binding agreement with the User selling the Product to purchase the Product using the payment facilities available on the Getit Platform.
• The User buying the Products using the Getit Platform, may receive a call or SMS from Getit Stores seeking a confirmation with regard to the delivery and satisfaction with the Product, in the event the User is not satisfied with the Product, the User shall have the right to seek a refund or exchange the Product within upon within a period of 30 (Thirty have) days from the date of delivery of the Product, as per Return, Reject and Cancellation Policy.
• It is hereby clarified that a refund shall be conditional and shall be with recourse available to Getit Stores in case of any misuse by the User.
• It is hereby clarified that all Products or services made available to a User through the Getit Platform are provided on an ‘as is’ and ‘as available’ basis, without any representations and warranties, express or implied by Getit Stores. Getit Stores does not make any representations pertaining to the information, content, Products or services included on or otherwise made available to a User through the Getit Platform.
• Nothing contained herein shall authorize a User to use, display or exploit the intellectual property rights of Getit Stores without the prior written consent of Getit Stores. The User, selling its Products on the Getit Platform shall have the right to state that Products are available on Getit Platform at its offline stores and other promotional and advertisement initiatives for the Products.
• Confidential Information shall mean all the information of a confidential nature disclosed (whether in writing, verbally or by any other means and whether directly or indirectly) by Getit Stores to a User whether before or after the date of these Terms and Conditions. The User, where applicable, shall not, during the pendency of these Terms and Conditions, or at any time after these Terms and Conditions and the Policies expire or terminate, divulge or use any Confidential Information for the benefit of any other person, corporation, partnership, proprietorship, association, or other entity, nor will the User, directly or indirectly permit the disclosure of any Confidential Information or aid any third party to imitate any Confidential Information.
• Getit Stores shall not be liable for its failure to perform under these Terms and Conditions and the Policies as a result of occurrence of any force majeure events like acts of God, fire, wars, sabotage, civil unrest, labour unrest, action of statutory authorities or local or central governments, change in laws, rules and regulations, affecting the performance of Getit Stores, payment gateways or the logistic support partner.
• It is agreed and clarified that the arrangement set out by these Terms and Conditions and the Policies between Getit Stores and the User is on a non-exclusive basis.
• As a User, your access to and use of the Getit Platform are conditional upon your acceptance of and continuous compliance with these Terms and Conditions at all times. By accessing, browsing and/or using the Getit Platform and/or availing any of the Services and/or Indirect Services, you agree to be bound by these Terms and Conditions and all rules, guidelines, policies, terms and conditions applicable to the Getit Platform and/or Services and/or Indirect Services being provided by Getit Stores (“Policies”), as may be modified by Getit Stores from time to time, which shall be deemed to be incorporated in these Terms and Conditions by reference, unconditionally and at all times. Getit Stores shall have the sole right to change, modify, add or remove these Terms and Conditions or any of its Policies relating to the provisions of Services on the Getit Platform, at any time without any prior written notice or intimation. It is hereby clarified that each User shall be responsible for reviewing the Terms and Conditions and Policies on the Getit Platform periodically and keep updated.
• Prior to using the http://www.askmebazaar.com/icicibankoffers website, the Customer should read and understand the Terms and conditions of the said website (http://www.askmebazaar.com/termsconditions.php) and proceed to make purchases only if the Account holder agrees to abide by the same.

V. Terms and Conditions applicable to the Offer prescribed by ICICI Bank

• This offer is brought to you solely by the alliance partner. ICICI Bank is only communicating this offer on behalf of the Alliance partner.
• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the alliance partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Net Banking User/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Net Banking User/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Net Banking User/s.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the alliance partner.
• ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the goods and services or the Cash back / discounts offered by the Alliance Partner. Any dispute or claim regarding the goods, services and cash back / discounts must be resolved by the Card Holder/s with the Program Partners directly without any reference to ICICI Bank.
• ICICI Bank reserves the right to disqualify the Program Partner/s or Card Holder/s from the benefits of the Program if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Program or otherwise by use of the Card.
• ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the goods and services or the assured gifts / prizes.
• The Program is not available wherever prohibited and / or on merchandise / products / services for which such programs cannot be offered for any reason whatsoever.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at @ help@getitbazaar.com or 04444 4444 without any reference to ICICI Bank. The same shall be addressed by AskmeBazaar only up to a period of 15 days after the date of transaction/purchase.
• All communication / notices with regard to this offer should be addressed to Getit Infoservices Pvt. Ltd. address: GYS Heights, Plot 10&11, Sector 125, Gautam Budh Nagar, Noida 201301.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank / Alliance partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank Net Banking User/Cardholders ceases to be a ICICI Bank Net Banking User/Cardholders at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Net Banking User/Cardholders.
