• “Alliance Partner” shall mean Flipkart Advanz Private Limited (“FAPL”) and Myntra Designs Pvt. Ltd, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• "ICICI Bank Net Banking Service(s)" shall mean internet banking services of ICICI Bank offered to ICICI Bank Net Banking User.
• "Card" shall mean Credit card (VISA/ Mastercard/ Amex) or Debit card (VISA/Electron/Maestro), which has been issued by ICICI Bank and is valid and subsisting during the Program/Offer Period.
• "Card Holder/s" shall mean such customer/s to whom a Card has been issued and who is authorized to hold the Card.
• "Program/“Offer” shall mean such cashback(s)/ discount(s) /benefit(s) provided by the Alliance Partner on purchase of Products/Services using ICICI Bank Net Banking Services, during the Offer Period on the Website.
• “Program/Offer Period” shall mean the period commencing from 00:00:00 hrs of 7th August, 2021 – 23:59:59 hrs of 12th August, 2021.
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to e ICICI Bank’s internet banking facility/service.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• “Website” shall mean the following website of the Alliance Partner www.myntra.com .
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been canceled /rejected /unsuccessful by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

· Place the order to receive your Myntra code (on your registered e-mail ID and mobile number)

· ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the Products under the Offer provided by the Alliance Partner.

· Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the Customers due to provision of the Offer, shall be to the sole account of the Customers. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the Customers.

· All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at the Alliance Partner’s Website without any reference to ICICI Bank. The same shall be addressed by Alliance Partner, only as mentioned on their Website.

· The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.

· The Offer is not available wherever prohibited and / or on Products for which such offers cannot be made available for any reason whatsoever.

· ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.

· If the Customer ceases to be a Customer at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to Customer.

· The ICICI Bank Customer(s) may avail the Offer during the Offer Period or until the Products lasts with ICICI Bank whichever is earlier. This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank or its Customer/s. The Offer is non-transferable, non-binding and non-encashable.

· This Offer is not valid for Void Transactions.

· All disputes are subject to the exclusive jurisdiction of the competent courts/tribunals of Mumbai. However, ICICI Bank reserves the right to approach any other court or tribunal of competent jurisdiction.

· ICICI Bank holds out no warranty or makes no representation about the quality, delivery or otherwise of the Products offered by the concerned Alliance Partner. Any dispute or claim regarding the Products and Offer must be resolved with the concerned Alliance Partner without any reference to ICICI Bank.

· ICICI Bank reserves the right to disqualify the concerned Alliance Partner or Customers from the benefits of the Offer if any fraudulent activity is identified as being carried out for the purpose of availing the benefits under the Offer or otherwise by the use of the internet banking facility.

· ICICI Bank shall not be held liable for any delay or loss that may be caused in delivery of the Products.

· ICICI Bank has the right to withdraw the Offer without any prior notice.

a) Terms and conditions prescribed ICICI Bank Credit & DebitCardHolders

· Myntra E- Gift Card is issued by Qwikcilver Solutions Pvt. Ltd which is a private limited company incorporated under the laws of India, and is authorized by the Reserve Bank of India ("RBI") to issue such Gift Cards.

· This E-Gift Card is redeemable only on Myntra marketplace platform.

· This E-Gift Card shall have a minimum validity period of 1 Year.

· This E - Gift Card cannot be used to purchase other gift cards.

· Multiple E-Gift Cards can be clubbed in a single order. E -Gift Cards cannot be redeemed for Cash or Credit and cannot be reloaded.

· This E-Gift Card can be redeemed online against sellers listed on www.myntra.com or Myntra Mobile App only.

· In cases where the order is cancelled, the E- Gift Card amount shall be refunded to the source E-Gift Card. The E - Gift Card amount shall not be refunded to the user's cashback account.

· The balance amount, if any, of the cost of the item being purchased by the Customer, after the discount has been availed, will have to be paid by the Customer at the time of purchase. If the order value exceeds the E -Gift Card amount, the balance must be paid by Credit Card/Debit Card/Internet Banking/Cash on Delivery.

· Extra VAT may apply in addition to the unit sale price on certain products, but the final inclusive price will not exceed the 'M.R.P.

· All taxes, duties, levies or other statutory dues and charges payable in connection with the benefits accruing under the offer shall be borne solely by the Customer.

· If the order value is less than the amount of the E - Gift Card, the outstanding balance (after deduction of order value) will reflect under the same E -Gift Card and can be used for subsequent transactions.

· For individual retail customers E - Gift Cards can be purchased on www.myntra.com or Myntra Mobile App using the following payment modes only - Credit Card, Debit Card and Net Banking.

· Gift Cards can be redeemed by selecting the payment mode as Gift Card.

· You are solely responsible for the safety and security of the E -Gift Cards. myntra.com/Qwikcilver Solutions are not responsible for any acts of omission or commission if Gift Card is lost, stolen or used without permission.

· Once the E - Gift Card has been sent to the customer, then the customers are bound to protect the E-Gift Card PIN or E -Gift Card number. In the event of any misuse of E -Gift Card due to loss of any such confidential details due to the fault of the purchaser/customer, myntra.com/ Qwikcilver Solutions Pvt. Ltd shall not be held responsible for the same and no refund can be issued against such E -Gift Cards.

· Myntra.com/Qwikcilver Solutions assume no responsibility for the products purchased using the E - Gift Card and any liability thereof is expressly disclaimed. Product warranty shall be regulated by the terms and conditions mentioned on the warranty card of respective products.

· Validity of E - Gift Card cannot be extended, new E - Gift Card cannot be provided against the expired/unused E - Gift Cards.

· Qwikcilver/Myntra reserves the right to cancel the E - Gift Card if the same have been found to be purchased with fraudulent means and/or the beneficiary/Know Your Customer ("KYC") details as per RBI Guidelines are found to be incorrect/insufficient. In such cases, the funds shall be credited back to the same source from where these were received.

· You agree and understand that E - Gift Cards are a pre-paid payment Instrument subjected to regulations by RBI Under the RBI guidelines, Myntra/ Qwikcilver Solutions Pvt. Ltd may be required to share KYC details of the purchaser/ redeemer of the Gift Card and/or any other information with relation to the purchase of the Gift Cards and/or transaction undertaken using the Gift Card with RBI or such statutory authorities. Myntra/ Qwikcilver Solutions Pvt. Ltd may contact the purchaser/redeemer of the GC for any such information.

· Myntra along with its sellers reserves the right to change the terms and conditions of the E-Gift Card, including extending, withdrawing or discontinuing the same without notice, at its sole discretion.

· All orders would be subject to availability at the time of purchase and will be governed by the standard terms and conditions on myntra.com. In case of return of the purchased item, please refer to the “Return Policy” on our website or write to returns@myntra.com.

· All disputes arising out of or in connection to this scheme are subject to exclusive jurisdiction of the courts in Bangalore only.
