Terms and Condition

I. DEFINITIONS

• “Alliance Partner” shall mean Novarris Fashion Trading Private Limited; hereby referred to as Jabong.com, who has entered into an alliance agreement with ICICI Bank for purpose of providing the Offer.
• “Customer/s” for the purpose of this Offer shall mean a person who holds a valid holds a valid AMEX/VISA/MASTER Credit Card or ICICI Bank VISA/MASTER Debit card issued by ICICI Bank and who has received communication from ICICI Bank with respect to the Offer.
• “Cardholder” shall mean a customer to whom the Facility has been granted by virtue of such customer holding a Card.
• "Card" shall mean Credit card or Debit card, which has been issued by ICICI Bank and is valid and subsisting during the Offer Period.
• “Offer” shall mean cashback) provided by the Alliance Partner on purchase of Products listed on the Alliance partner’s website using ICICI Bank Credit card or Debit card , during the Offer Period on the Website.
• “Offer Period” shall mean the period commencing from 11 August (from 00:00 hrs) till August 15, 2018 (23:59 hrs) both days inclusive
• "Primary Terms and Conditions" shall mean the terms and conditions applicable to be ICICI Bank’s Credit card or Debit card facility/service.
• “Products/Services” shall mean the goods/benefits/facilities offered by the Alliance Partner.
• “Website” shall mean the following website of the Alliance Partner www.jabong.com | m.jabong.com or Jabong mobile app
• “Void Transaction” shall mean any transaction wherein the transaction has taken place but has been cancelled /rejected /unsuccessful by the Alliance Partner.

All capitalized terms used but not defined herein shall have the respective meanings prescribed to them in the Primary Terms and Conditions. These terms (“Terms”) shall be in addition to and not in derogation of the Primary Terms and Conditions. To the extent of any inconsistency between these Terms and Primary Terms and Conditions, these Terms shall prevail.

II. OFFER:

• Shop on Jabong using ICICI Bank Debit & Credit Cards and get 10% Cashback on minimum transaction of Rs.2999
• Maximum cashback of Rs.500
• Offer valid only on transactions made using ICICI Bank Credit card or Debit Card
• Offer Period: August 11 (from 00:00 hrs) till August 15, 2018 (23:59 hrs) both days inclusive
• Offer is applicable on both Jabong App, msite and Website.
• Cashback will be credited to customer’s accounts within 60 days of end of the offer period

The availability of the offer is based on the following criteria:

• To avail benefits under the Offer the ICICI Bank Debit & Credit Card holder shall be required to make a transaction/purchase on the Website using ICICI Bank debit or credit card during the Offer Period
• The Offer is valid only for select set of ICICI debit & credit cards(s) selected at the sole discretion of ICICI Bank and who have received communication about the Offer from ICICI Bank, during the Offer Period.
• Participation in the Offer by the ICICI Bank card holder is on a voluntary basis.
• The ICICI Bank Card holder/s may avail the Offer during the Offer Period or until the stock lasts, whichever is earlier.
• This Offer cannot be clubbed with any other Offer that may be made available to the ICICI Bank card holder/s by the Alliance Partner.
• The Offer is non-transferable, non-binding and non-encashable.
• The Offer is not valid for Void Transactions

III. TERMS PRESCRIBED BY THE ALLIANCE PARTNER

• NRE account holders will not be eligible to avail the said Offer.
• Under this program, ICICI Bank cardholder can avail additional cashback on the billing value, net of discount if any, from merchants.
• In the event orders are cancelled or returned either by Jabong or by customer, the customer will not be eligible for the cashback.
• The Cashback amount will be calculated on the net transaction value.
• Cashback will be credited to customer’s accounts within 60 days of end of the offer period.
• Offer is not applicable on gold coins, precious Jewellery, Innerwear, Beauty Products, Tommy Hilfiger, Casio, Gini & Jony, Jockey.
• ICICI Bank and Jabong reserve the right to modify, withdraw or discontinue the Offer without assigning any reasons whatsoever. Neither anything contained in these terms and conditions, nor shall running this Offer be construed as an obligation on the Bank to continue the Offer up to the termination/expiry date.
• Under no circumstance will the offer/discount being offered under this Program be settled with cash in lieu by ICICI Bank or by Merchant.
• Participation in this Offer is entirely voluntary and it is agreed and understood by the Participants that participation shall be deemed to have been made on a voluntary basis.
• The Offer is non-transferable, non-cashable, not extendable and non-negotiable.
• The Offer shall not be available wherever it is prohibited under law and/or cannot be made for any reason whatsoever.
• The Bank shall not be obliged to make any public announcements of the results of the Offer.
• In all matters relating to this Offer, the decision of the Bank shall be final and binding.
• By participating in the Offer, the Participants agree to be bound by the terms and conditions contained herein.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the client due to provision of the offer, shall be to the sole account of the client.
• All disputes under this Offer are subject to the exclusive jurisdiction of the competent courts/ tribunals of New Delhi.

IV. GENERAL TERMS

• ICICI Bank does not guarantee and make any representation about the usefulness, worthiness and/or character of the discount / benefit or of the Products/Services under the Offer provided by the Alliance Partner.
• Any tax or other liabilities or charges payable to the government or any other statutory authority/body or any participating establishment, which may arise or accrue to the ICICI Bank Cardholder/s due to provision of the Offer, shall be to the sole account of the ICICI Bank Cardholder/s. Tax deducted at source, if any, on the monetary value of the Offer shall be payable by the ICICI Bank Cardholder/s.
• All issues / queries / complaints / grievances relating to the Offer, if any, shall be addressed to Alliance Partner directly at Novarris Fashion Pvt Ltd without any reference to ICICI Bank. The same shall be addressed by Alliance Partner, only up to a period of 15 days after the date of transaction/purchase.
• The existence of a dispute, if any, regarding the Offer shall not constitute a claim against ICICI Bank and shall be addressed directly by the Alliance Partner.
• All communication / notices with regard to this Offer should be addressed Novarris Fashion Pvt Ltd.
• The Offer is not available wherever prohibited and / or on products / services for which such offers cannot be made available for any reason whatsoever.
• ICICI Bank/Alliance Partner reserve the right to modify/ change all or any of the terms applicable to the Offer without assigning any reasons or without any prior intimation whatsoever. ICICI Bank also reserves the right to discontinue the Offer without assigning any reasons or without any prior intimation whatsoever.
• If the ICICI Bank Cardholderceases to be an ICICI Bank Cardholder at any time during the currency of the Offer Period, all the benefits under the Offer shall lapse and shall not be available to the ICICI Bank Cardholder.
